These Terms of Use ("Terms") govern your access to and use of Motiq ("Motiq", "we", "our", or "us"), including our mobile application, website, and related services.

Motiq is an AI-powered focus app designed to help users start tasks by turning what they are avoiding into small, actionable steps.

By using Motiq, you agree to these Terms. If you do not agree, please do not use the app.

1. Use of the App

You may use Motiq only for lawful, personal, and non-commercial purposes, unless we give you written permission otherwise.

You agree not to:

• Use the app for illegal, harmful, abusive, or fraudulent purposes
• Attempt to reverse engineer, copy, or exploit the app or its systems
• Interfere with the security, availability, or performance of the app
• Bypass usage limits, subscription restrictions, or access controls
• Submit content that is unlawful, harmful, abusive, or violates the rights of others
• Use automated systems, bots, or scripts to access the app without our permission

2. Account Registration

Some features may require you to create an account. You are responsible for keeping your login credentials secure and for all activity under your account.

You agree to provide accurate information and to update it if necessary. If you believe your account has been accessed without permission, please contact us immediately.

3. AI-Generated Suggestions

Motiq uses AI to generate focus plans, smaller steps, continuation plans, and related suggestions.

AI-generated suggestions may not always be accurate, complete, appropriate, or suitable for your situation. You are responsible for deciding whether and how to follow any suggestion.

Motiq does not provide medical, psychological, therapeutic, legal, financial, or professional advice. The app is designed for productivity and focus support only.

If you are experiencing a crisis, emergency, or serious mental health concern, please contact local emergency services or a qualified professional.

4. User Content

You may submit tasks, moods, reflections, notes, and other content while using Motiq ("User Content").

You retain ownership of your User Content. However, you grant us a limited right to process, store, and use your User Content as needed to provide, maintain, personalize, secure, and improve the app.

You should not submit sensitive personal information, financial information, medical information, passwords, confidential business information, or any content you do not have the right to share.

5. Subscriptions and Premium Features

Motiq may offer free and paid features. Premium features may include unlimited AI starts, unlimited continuations, stronger personalization, or other features described in the app.

Subscription purchases are processed through the App Store, Google Play, and/or RevenueCat. We do not directly process or store your full payment card information.

Subscription prices, billing periods, free trials, renewals, and cancellations are shown before purchase and may vary by platform, country, currency, or promotional offer.

6. Subscription Renewal and Cancellation

Subscriptions may automatically renew unless cancelled before the renewal date according to the rules of the App Store or Google Play.

You can manage or cancel your subscription through your App Store or Google Play account settings.

Deleting your Motiq account does not automatically cancel an active subscription managed by Apple or Google. You must cancel your subscription through the relevant app store if you do not want to be charged again.

7. Refunds

Refunds for purchases made through the App Store or Google Play are handled by Apple or Google according to their own policies.

We do not control App Store or Google Play refund decisions. If you believe you are eligible for a refund, please request it through the platform where you made the purchase.

8. Account Deletion

You can delete your account from within the Motiq app. When you delete your account, we will delete your account and associated personal data from our active systems, unless we are legally required to retain limited information.

Account deletion does not automatically cancel an active subscription managed by Apple or Google. You must cancel your subscription separately through your app store account.

9. App Availability and Changes

We may update, modify, suspend, or discontinue parts of Motiq at any time. We may also change, add, or remove features, including free or premium features.

We aim to keep the app reliable, but we do not guarantee that Motiq will always be available, error-free, uninterrupted, or compatible with every device or operating system.

10. Intellectual Property

Motiq, including its design, branding, software, features, text, graphics, and other content, is owned by us or our licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, sell, lease, or create derivative works from Motiq or any part of the app unless we give you written permission.

11. Third-Party Services

Motiq may rely on third-party services such as RevenueCat, Brevo, AI service providers, App Store, Google Play, hosting providers, and analytics or infrastructure services.

These third-party services may have their own terms and privacy policies. We are not responsible for third-party services that we do not control.

12. Acceptable Use

You agree not to use Motiq to:

• Harass, threaten, abuse, or harm others
• Generate or submit illegal, harmful, or exploitative content
• Attempt to access another user’s account or data
• Probe, scan, or test the vulnerability of our systems
• Bypass subscriptions, limits, security controls, or technical protections
• Use the app in a way that could damage, disable, or overload our services

13. Termination

We may suspend or terminate your access to Motiq if you violate these Terms, misuse the app, create risk for other users, or use the app in a way that may harm our services or business.

You may stop using Motiq at any time and may delete your account from within the app.

14. Disclaimers

Motiq is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that Motiq will meet your expectations, produce specific results, improve your productivity, or be free from errors or interruptions.

15. Limitation of Liability

To the fullest extent permitted by law, Motiq and its owners, team members, partners, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses.

Our total liability for any claim related to Motiq will be limited to the amount you paid to use Motiq in the twelve months before the claim, or the minimum amount permitted by law if you did not pay anything.

16. Indemnification

You agree to defend, indemnify, and hold harmless Motiq and its owners, team members, partners, and service providers from any claims, damages, losses, liabilities, costs, or expenses arising from your use of the app, your User Content, or your violation of these Terms.

17. Governing Law

These Terms will be governed by and interpreted in accordance with the laws of the jurisdiction where we operate, unless otherwise required by applicable consumer protection laws.

If you are a consumer, you may have mandatory rights under the laws of your country or region that cannot be limited by these Terms.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify you through the app, by email, or by updating the "Last updated" date at the top of this page.

Your continued use of Motiq after updated Terms are posted means you accept the updated Terms.
